TENTATIVE RULING:

The motion for turnover order is TAKEN OFF CALENDAR.

BACKGROUND:

On September 17, 2010, Plaintiff Paul M. Diaz commenced this case against Defendants Ruben Mas, Maria Gonzalez, and Bank of America.

On January 28, 2011, Plaintiff filed a first amended complaint for (1) declaratory relief; (2) conversion; (3) aiding and abetting conversion; (4) breach of duty of care; (5) breach of contract; (6) breach of promissory note; and (7) breach of implied covenant of good faith and fair dealing.

On October 12, 2011, pursuant to Plaintiff’s request, the Court dismissed Maria Gonzalez and Bank of America, N.A. from this action.

On March 21, 2012, the Court granted Plaintiff’s request for entry of default judgment against Defendant Ruben Mas in the amount of $121,201.61.

On June 21, 2018, Plaintiff filed an acknowledgement of assignment of judgment to Graham-Newman, LLC.
