This is an action in which Plaintiff seeks to collect on a promissory note from Defendant. On December 14, 2011, Plaintiff filed the operative First Amended Complaint alleging causes of action for (1) breach of contract, (2) book account, and (3) money lent.
Defendant seeks a bond pursuant to Code Civ. Proc. § 1030 to secure her award of attorneys’ fees and costs should she prevail in this matter. Defendant seeks reconsideration of the Court’s August 21, 2017, ruling denying a bond.
The Motion is DENIED because (1) Defendant has not presented any new law on the issue of whether she is entitled to a bond pursuant to Code Civ. Proc. § 1030 to the extent she is not a California resident (Code Civ. Proc. § 1008
