Tentative ruling for October 30, 2020 on Defendants Habeeb Syed's and Defendant Kaleem Syed's demurrers to and Defendant Habeeb Syed's motion to strike portions of the First Amended Complaint (FAC), and Defendant Kaleem Syed's motion to disqualify attorney Anne Singer and for Order Requiring Disgorgement of Profits
As to the demurrers and motion to strike, the court is inclined to adopt the tentative rulings issued for the October 14, 2020 hearing.
The court is inclined to grant defendants' motion to disqualify attorney Singer from representation of the Corporation, in light of the allegations in the consolidated matter brought by Syed.
The original moving papers also requested disgorgement of funds paid by HS&S to Singer; however, that issue has not been addressed in the supplemental briefing. If Kaleem Syed still seeks disgorgement, he may file a separate motion for disgorgement once the corporation is separately represented.
