The Court intends to Grant the motion for summary judgment. Under the circumstances established, defendant Margus Limited owed no duty to the decedent.

All of plaintiffs' evidentiary objections are overruled. All of defendant Margus's evidentiary objections except numbers 5, 6 and 8 are sustained.

For purposes of this motion only the court finds:

UMFs 1, 3, 4, 6, 8, 10, 13, 14, 15, 21, 22 and 23 are undisputed.

UMFs 2, 5, 9, 11, 16, 17, 18, 19 and 20 are disputed, but nonetheless established. UMF 12 is disputed and not established by the evidence cited to by defendant. UMF 7 is disputed. All but that portion of it which suggests Parminder had rented forklifts from U-Rent approximately 22 times is established. As to that portion, it is not established by the evidence cited to by defendant.
