The will purports to gift decedent's entire estate to his surviving siblings. The probate petition was filed by decedent's sister, Lucille.

A will contest was filed on March 8, 2017 by decedent's wife, Mary. An amended petition contesting the will was filed on March 29, 2017. A demurrer and motion to strike was filed by Lucille on May 4, 2017. As part of the pleading challenges, Lucille submits a judgment for legal separation filed by decedent's wife in case D376784 on October 5, 2016, and a petition for dissolution of marriage by decedent's wife in case D379755 on December 22, 2016. The wife's dissolution petition was filed 15 days before decedent signed the alleged handwritten will, giving his assets to his siblings.
