1. Overview and Procedural Posture.

This is a medical negligence case arising out of an incident on July 10, 2018. Plaintiff, who is herself a physician, alleges she was "severely injured by the negligence of SDSM's employee (a therapist named "Sean") ... when he carelessly dropped her during a rubber band exercise they were performing." She later had an MRI which "revealed a compression fracture of the L1 and L2 vertebra with edema." The complaint was filed in October 2019, and defendants answered the following month. ROA 10.
