TENTATIVE RULING:

(1) POWAY UNIFIED SCHOOL DISTRICT's Demurrer to Voice of San Diego's Amended Complaint and Petition in Intervention is SUSTAINED.

To the extent this demurrer was untimely filed, the Court may treat it as a motion for judgment on the pleadings.

This action was commenced by Doe, who sought to prevent disclosure of parts of his personnel records after Voice of San Diego ("VoSD") made a California Public Records Act ("CPRA") request for records to Respondent Poway Unified School District ("PUSD"). VoSD's CPRA request concerned other teachers besides DOE. VoSD sought, and was granted, leave to intervene in this action. VoSD's Complaint in Intervention attempts to expand the scope of this litigation to records pertaining to persons besides DOE, the Petitioner in this case. Unlike this reverse CPRA action where PUSD supported disclosure, VoSD is seeking to force PUSD to disclose records as to others persons involved in the records request.
