The basis of Defendant's motion is the court's minutes at an informal discovery conference. Those minutes state: "in regards to response to special interrogatories, counsel stipulate to arrange a deposition of Judy Marsh through an attorney's eyes only process." (ROA 29.) An informal discovery conference with the court is informal in nature. The court does not make rulings or issue orders at informal discovery conferences. Rather, the court's role is to assist the parties in attempting to informally resolve their discovery dispute without the need for a formal court order.
