MOTION TO COMPEL RESPONSES TO FORM INTERROGATORIES, SPECIAL INTERROGATORIES, REQUESTS FOR PRODUCTION OF DOCUMENT, TO HAVE REQUEST FOR ADMISSIONS DEEMED ADMITTED is GRANTED in part and MOOT in part. The Court in its discretion has considered the late opposition. Plaintiff states responses to form interrogatories, special interrogatories, requests for production of documents and requests for admission were served by mail on January 7, 2020. The responses do not contain objections. Therefore, this motion is moot as to the interrogatories and production of documents. As for the request for admissions, the court finds the responses served January 7, 2010 are in substantial compliance. (CCP §§ 2033.280.280(a)) Sanctions are mandatory. (CCP § 2033.280) Plaintiff failed to serve a timely response to the Requests for Admissions, which necessitated this motion. Accordingly, plaintiff shall pay sanctions of $1,250 to defendant by January 24, 2020.
