Plaintiff Douglas D. Richman's Motion for Attorney Fees is DENIED. (ROA 268.) Defendant Regents of the University of California argues Plaintiff is precluded from obtaining fees, relying on Regents of University of California (2011) 191 Cal.App.4th 703. The court does not agree. Goldbaum determined Regents was constitutionally immune from the reach of Labor Code section 218.5. Code of Civil Procedure section 1021.5 was not considered or discussed. However, the court finds Plaintiff has not met his burden to prove the judgment he obtained in this action resulted in the enforcement of an important right affecting the public interest or conferred a significant benefit on the general public or a large class of persons. Accordingly, Plaintiff is not entitled to fees pursuant to section 1021.5.
