Plaintiff Chad Albright ("Plaintiff")'s motion for terminating sanctions or, alternatively, compliance with the court's discovery orders, and for monetary sanctions, is granted.
The court deems Defendant Lawrence Burzynzki aka Lawrence Burns aka Larry Burns ("Defendant")'s lack of opposition to be a concession as to the motion's merits. In addition, the uncontroverted evidence establishes that on March 6, 2020, the court ordered Defendant to provide verified responses, without objections, to Plaintiff's Form Interrogatories (Sets Two and Three) and Special Interrogatories (Set Two) within 30 days after service of its discovery orders. See ROA Nos. 116 and 118. The court also directed Defendant to pay Plaintiff monetary sanctions by March 27, 2020. Ibid. Plaintiff served Defendant with the court's discovery on March 9, 2020.
