The operative pleading in this case is the Verified Complaint for Declaratory and Injunctive Relief and Petition for Writ of Mandate Under the California Public Records Act and Other Laws. The moving papers that were submitted by Plaintiff/Petitioner San Diegans for Open Government ("SDOG") is entitled "Opening Brief on the Merits." Whether considered in the context of a petition for writ of mandate or complaint for declaratory and injunctive relief, it appears to the Court that both parties agree the matter may be decided on the papers submitted.

The Court has reviewed the arguments of the parties and the evidence submitted, as well as SDOG's operative pleading and concludes that under the facts of this case, the Poway Unified School District exercised reasonable effort in responding to SDOG's California Public Records Act request. As a result, the Court denies SDOG's request for a writ of mandate and/or declaratory and/or injunctive relief.
