TENTATIVE RULINGS

Plaintiff Access Psychology, P.C.'s motion for terminating sanctions is denied. The court previously noted plaintiff has previously objected to defendant's late filed oppositions on more than one occasion and cautioned defendant to timely ensure any opposition papers comply with Code of Civil Procedure section 1005. Although defendant has explained he believed the Fourth District Court of Appeal had not ruled on his writ proceeding, which was why he did not proceed with his deposition, plaintiff was required to incur additional expenses in filing the motions. Furthermore, defendant filed the responses to the request for production of documents December 19, 2018, with objections. The court sanctions defendant and his attorney $750 for failing to follow the Rules of Civil Procedure and failing to appear at his deposition and produce documents. The sanctions shall be paid within 30 days of the final order.
