DEFENDANTS’ DEMURRER TO PLAINTIFFS’ COMPLAINT

Background

Defendants Western General Insurance Company (“Western”) and Jeremy Remington (“Remington”) (jointly, “Defendants”) bring this demurrer to the entire Complaint of Plaintiffs Harutun Karatavukyan and Anahid Sarkees (jointly, “Plaintiffs”). Plaintiffs oppose.

Plaintiffs allege that they were insureds under a car insurance policy issued by Western at the time of a collision between Mr. Karatavukyan’s vehicle and an unidentified vehicle. (Compl., ¶¶ 6-7.) The policy provided uninsured motorist bodily injury coverage. (Compl., ¶ 6.) Plaintiffs allege that after submitting their claim to Western (for which a claim number was issued on or about September 11, 2017), Western unreasonably delayed resolution of the claim. (Compl., ¶ 9.
