Plaintiff's motion to compel compliance with the deposition subpoena for production of business records to Bank of America, N.A. is granted.

As an initial matter, the Court concludes that Plaintiff's motion is timely. If a nonparty disobeys a deposition subpoena, the subpoenaing party may seek a court order compelling the nonparty to comply with the subpoena within 60 days after completion of the deposition record. Code Civ. Proc. § 2025.480(b). The objections or other responses to a business records subpoena are the "deposition record" for purposes of measuring the 60-day period for a motion to compel. See Unzipped Apparel, LLC v. Bader (2007) 156 Cal.App.4th 123, 132-33.

In this case, Plaintiff issued a deposition subpoena to Bank of America on May 21, 2018. Plaintiff later determined that the subpoena was not properly served and issued another deposition subpoena on September 12, 2018.
