The motion to stay is granted.

CCP §916(a) provides "... the perfecting of an appeal stays proceedings in the trial court upon the judgment or order appealed from or upon the matters embraced therein or affected thereby. ... but the trial court may proceed upon any other matter embraced in the action and not affected by the judgment or order."

Although the summary judgment relates solely to Black Mountain Ranch, LLC, there is a substantial overlap of the issues in the case against the other defendants. If the judgment is affirmed, that may very well resolve some of the issues against the other defendants even though the willful acts may be somewhat different. The Court of Appeal may set forth some standards that plaintiffs are required to establish. If the judgment is reversed, again the Court of Appeal may comment on the standards required for the plaintiff to establish.
