On May 20, 2016, the jury in this case found against Plaintiff on all of her claims. Plaintiff filed a motion for new trial as to the jury's verdict but by way of her supplemental brief Plaintiff eliminated certain causes of action, including her claims of disparate treatment disability discrimination. As a result, the motion proceeded only on the following causes of action: second cause of action for physical disability discrimination – failure to accommodate; third cause of action for physical disability discrimination – failure to engage in the interactive process; and sixth cause of action for failure to prevent harassment, retaliation and discrimination. The motion as to those causes of action was granted. The Defendant appealed. The court of appeal affirmed the order granting the motion for new trial.
