The Court issues the following tentative ruling in advance of the compliance hearing set for December 11, 2020, at 11:00 a.m., by remote appearance in Department 40.
The Court has received the Second Supplemental Declaration of Derek Smith re: Distribution of Settlement Funds (Smith Declaration), filed December 3, 2020.
No appearance is required subject to the following conditions:
The Smith Declaration indicates that the remaining outstanding class payment has a void date of January 31, 2021. The payment to the cy pres beneficiary can be ascertained and made thereafter. The Court will schedule the next compliance hearing for March 5, 2021, at 9:00 a.m., by remote appearance in Department 40.
The Plaintiff shall file via email to Dept40@saccourt.ca.gov, an updated declaration from the administrator by 14 days prior to the hearing. If all payments have been made, including that to the cy pres beneficiary, the Court intends to not require appearances and deem the matter closed at tha
