As a matter of general reference, this Motion for Award of Prejudgment Interest filed by Defendant and Cross-Complainant Travelers Property Casualty Company of America ("Travelers") comes before the at the conclusion of three phases of litigation based on two underlying construction defect lawsuits known as Redig v. Centex and Van Loon v. Centex. Underlying both Van Loon and Redig were insurance policies issued by Travelers to subcontractors that performed work on some of the houses that were included in each lawsuit.

As the Court has previously noted in other contexts in this case, Phase I concerned certain legal issues submitted to the Court for determination, including issues pertaining to Centex' asserted right to independent counsel and the effect of certain Scope of Work releases negotiated by Travelers.
