The motion is conditionally granted as set forth below.
Defendants anticipate that plaintiff Sacramento Area Flood Control Agency ("SAFCA"), its counsel, and/or its experts, and in particular its expert appraiser, may introduce opinion testimony that directly criticizes, reviews, judges, finds fault with, or evaluates the opinions or conclusions of Defendants' expert appraiser, Mr. Gimmy. Defendants move the court for an order in limine excluding such testimony on the grounds that SAFCA did not properly disclose its intent to offer such rebuttal testimony, that such testimony would not assist jurors in their determination of just compensation but would instead invade the province of the jury, that it would usurp the role of the Court as gatekeeper to determine comparability of sales, that it would necessitate undue consumptio
