The Court DENIES without prejudice Defendant Rosalba Meza’s Motion to Stay Case, or Alternatively, to Stay Discovery, Pending Resolution of the Criminal Case.
The Court GRANTS Plaintiffs’ unopposed request for judicial notice (ROA 117) of the existence and filing of court records in this action and Defendant’s declaration in another OC court case. (Evid. Code, § 452, subd. (d).)
With respect to Plaintiffs’ objections to defense counsel Pilchman’s declaration in support of the motion (ROA 116) and Defendant’s objections to attorney Wong’s declaration in support of the opposition (ROA 121), the Court SUSTAINS the hearsay objections but OVERRULES all other objections. Both declarants declare that they spoke to the same Anaheim police detective who is investigating Defendant. Unless the facts are declared by both attorneys, the court will not consider the detective’s statements for the truth of the matter asserted therein, but may consider them for any non-hearsay purpose.
