Order to Show Cause
The hearing on the OSC RE: Why the Administrative Deposition Subpoena Issued By the Labor Commissioner Should Not be Enforced (“OSC”) is Continued to 10/02/20.
Respondent Catholic Charities of Orange County, Inc. (“Respondent”), appears to have missed not only the Court’s 02/10/20 Order regarding pleadings on the OSC, but failed to abide by the requirements of CCP §§ 1005(b) and (c).
Respondent did not file its opposition nine-court days prior to the hearing as required by CCP § 1005(b), and did not serve the opposition in a manner reasonably calculated to ensured delivery of the opposition to petitioner Labor Commissioner for the State of California (“Petitioner”) no later than close of the next business day as the opposition was mail served. CCP § 1005(c)
In order to give Petitioner adequate time to receive, review, and respond to the opposition, the Court continues the hearing to 10/02/20. Petitioner is given leave to file a reply (or amended reply if it deems on
