Ruling: Defendants’ Motion for Judgment on the Pleadings is GRANTED, with 15 days leave to amend. (Code Civ. Proc., 438.)
Pursuant to Code of Civil Procedure section 438, a defendant may move for judgment on the pleadings on only two grounds: failure to state a cause of action, or lack of jurisdiction. (Code Civ. Proc., § 438(c)(1)(B)(i), (ii).) A motion for judgment on the pleadings may be made as to either the entire complaint “or as to any of the causes of action stated therein.” (Code Civ. Proc., § 438(c)(2)(A).) A motion for judgment on the pleadings performs the same function as a general demurrer, and hence attacks only defects disclosed on the face of the pleadings or by matters that can be judicially noticed. (Cloud v. Northrop (1998) 67 Cal.App.4th 995, 999).
The Complaint alleges that Moving Defendants defamed Plaintiff
