(1) MOTION TO COMPEL COMPLIANCE WITH SUBPOENA
Plaintiff Youngjin Seo’s motion to compel third-party Hyo Kwan Lee to comply with the business records subpoena served on him on 4/26/19 is denied as moot.
The Court notes that counsel for Lee filed a declaration/limited opposition, stating that on 12/4/19, Lee produced over 1,000 pages of documents to Plaintiff’s counsel in response to the subpoena at issue. The attorneys met and conferred thereafter, and Lee agreed to provide Plaintiff’s counsel a declaration confirming that Lee made a diligent search and reasonable inquiry and produced all responsive documents in his possession, custody and control. Thereafter, it was agreed that Plaintiff would withdraw his motion without prejudice. (Lee Decl., ¶¶ 2-4.)
Nothing has been field by Plaintiff disputing the foregoing. Accordingly, based on the limited opposition demonstrating compliance with the subpoena, it would seem the motion is moot.
