Defendant Berit Ling’s Motion to Strike Defendant Berit Ling moves to strike the punitive damages allegations and prayer for relief in Plaintiff WCST Enterprises, LLC’s Complaint. For the following reasons, Defendant’s motion is granted with leave to amend. To withstand a motion to strike punitive damages, a plaintiff must plead ultimate facts showing the plaintiff is entitled to such relief. Grieves v. Superior Ct. (1984) 157 Cal.App.3d 159, 166; see also Smith v. Superior Ct. (1992) 10 Cal.App.4th 1033, 1042 (complaint “devoid of any factual assertions supporting a conclusion petitioners acted with oppression, fraud or malice” subject to motion to strike punitive damages allegations). Plaintiff seeks punitive damages in paragraph 21 of the Complaint and paragraph 2 of the Prayer for Relief for the first cause of action. Plaintiff’s Complaint alleges no facts supporting an entitlement to punitive damages. Plaintiff also impermissibly states an amount of alleged punitive damages. See C
