Motion for Judgment on the Pleadings
The Motion by Cross-Defendants Brian Gruner, Jennifer Murphy, Marcy Sheinwold, and Beth Perak for judgment on the pleadings as to Cross-Complainant Alan Dickinson’s Second Amended Cross-Complaint (“SAXC”) is granted without leave to amend.
Cross-Defendants’ request for judicial notice is granted.
As an initial matter, the Court rejects Cross-Defendants’ argument that the Opposition filed by Cross-Complainant’s counsel was untimely. The Court considers that opposition. The Court also exercises its discretion to consider the separate opposition filed by Mr. Dickinson himself, as no objection was made to the filing of that document. The Court notes that Mr. Dickinson’s counsel is separately seeking to be relieved as counsel.
