Plaintiff/Cross-Defendant Finisterra Condominiums Association, Inc.’s demurrer to Defendant/Cross-Complainant Christina Garcia’s Second Amended Cross-Complaint (“SAXC”) is SUSTAINED without leave to amend as to the 1st cause of action and OVERRULED as to the 2nd and 6th causes of action.
As an initial matter, the Court reminds Defendant of her obligations under the Code of Civil Procedure to serve her opposing documents no later than 9 court days before the hearing pursuant to Code of Civ. Proc., § 1005(b) and also file proofs of service with the Court of the same pursuant to CRC, Rule 3.1300(c). Failure to do so in the future may result in the Court exercising its discretion to decline to consider such filings.
