Motion to Vacate Arbitration Award
The motion of the plaintiff to vacate the arbitrator’s award is DENIED.
The motion to vacate is based on the basic ground that the original order granting the defendants’ motion to compel arbitration was wrong. The Court of Appeal denied a petition for writ of mandate challenging the original order (see G055504), and a later appeal to the original order compelling arbitration (see G058621) was voluntarily dismissed after the Court of Appeal reminded the plaintiff that there is no right to appeal from the granting of a motion to compel but only from the final order/judgment.
The motion to vacate is essentially an untimely motion for reconsideration of this court’s 2017 order compelling arbitration.
The plaintiff also asks, in the alternative, that the court confirm the arbitrator’s award. That alternative motion is MOOT, as indicated infra.
