TENTATIVE RULING:
Plaintiff’s request for a preliminary injunction is granted in part and denied in part.
Requests (A) and (B) are granted as to defendant Mendoza (the tenant).
Request (A) (prohibiting leasing or allowing a dispensary) is granted as to defendants HNC Remarc Investors, LP (the owner) and Marc Cramer (agent who signed the lease on behalf of the owner) and denied as to defendants Remarc Management, Inc., Richard Leon Cramer, Richard Eric Cramer, and Eric Richard Cramer. [Collectively, these defendants are hereinafter referred to as the “landlord defendants.”] The granting of this relief as to defendants HNC Remarc and Marc Cramer is based on plaintiff’s representation in the Reply that it is seeking to prohibit prospective conduct only.
