A) Defendant Courtney Ellis-Dever’s Motion to Compel Depos of Alex Alvord and PMK for Digitalsound Production Services
On 1/29/16, Defendant Courtney Ellis-Dever noticed the depositions of Alex Alvord and the PMK for Digitalsound Production Services for 3/15/16 and 3/22/16. Plaintiffs served no formal objections to the deposition notices.
On 3/15/16, Alvord failed to appear for his properly noticed deposition. In Opposition, counsel for Alvord argues that this was a reasonable and excusable mistake. Counsel argue that they thought Defendant’s counsel, Brian Lauter, had agreed to continue the deposition to a date after Anthony Dever’s deposition set for 4/17/16. (Dillion Decl. at Ex. 4.)
