Defendants Paul Roger Oldfield and Tanya Erandonyan Oldfield (“Defendants” or “the Oldfields”) filed an ex parte application on September 9, 2020 seeking an order staying execution of a writ of possession that would remove them from their home on September 16, 2020 or thereafter, based on a stipulated judgment in this unlawful detainer action. The Oldfields seek relief under the Order of the Center for Disease Control, entitled “Temporary Halt in Residential Evictions to Prevent the Further Spread of COVID-19” and codified in 42 U.S.C. § 264 and 42 CFR § 70.2, effective September 4, 2020. They also rely on the Tenant, Homeowner, and Small Landlord Relief Act of 2020 (AB 3088), recently passed by the California Legislature and effective September 1, 2020. Plaintiff Three Cranes Real Estate USA, LLC (“Plaintiff”) opposes for a number of reasons as discussed below.
