Regency Park Astoria LLC and Regency Park Senior Living’s motion to compel Plaintiff Jane Doe’s claims to arbitration is CONTINUED to February 3, 2020.
On September 8, 2020, Plaintiff Jane Doe, through her Guardian Ad Litem T.W., brought the instant elder abuse suit against Defendants Regency Park Astoria LLC, Regency Park Senior Living, and Gordon Caldwell (“Caldwell”). The Complaint alleges that Regency runs a residential care facility for the elderly (“RCFE”). Plaintiff has a primary diagnosis of dementia. Regency allegedly neglected Plaintiff, where Plaintiff suffered from multiple falls. Moreover, Regency failed to provide necessary supervision, culminating in a rape by another resident, Caldwell. The Complaint states three causes of action for: 1) elder abuse and neglect, 2) negligence/willful misconduct, and 3) sexual battery.
