Demurrer without a Motion to Strike

Having considered the demurring papers, the Court rules as follows. No opposing papers were filed.

BACKGROUND

On April 24, 2020, Plaintiff William Jefferson (“Plaintiff”) filed a complaint against Defendants Doud Associates Inc., Armond Zaimtsyan, Patricia Sonntag, Patrick Sonntag, Cinemark USA, Inc., and Runway Owner LLC. Plaintiff alleges negligence and premises liability arising from a trip-and-fall that occurred on January 22, 2019 and a slip-and-fall that occurred on April 25, 2019.

On August 14, 2020, Defendant Doud Associates, Inc. filed a demurrer pursuant to California Code of Civil Procedure section 430.10.

On September 15, 2020, Defendants Cinemark USA, Inc. and Runway Owner LLC filed a joinder to Defendant Doud Associates, Inc.’s demurrer.

On October 15, 2020, Plaintiff filed a first amended complaint.

Trial is set for October 22, 2021.
