This action arises from an incident that allegedly occurred on 7/20/19, at an animal shelter managed, maintained, and operated by Defendant City of Los Angeles. Plaintiffs allege that while waiting to adopt their first family dog, a German Shepherd mix mauled the minor Plaintiff Daniel Wagner in the face in front of his family. Plaintiffs allege claims for negligence, strict liability pursuant to Civ Code § 3342, and negligent infliction of emotional distress.


Plaintiffs Daniel Wagner and Noah Wagner, by and through their guardian ad litem Allen Wagner, move for a preferential trial setting. Daniel is 8 years old, and Noah is 12 years old. Both have a substantial interest in this litigation as a whole since Daniel was bitten, and Noah suffered emotional distress witnessing the attack.
