[TENTATIVE] ORDER RE: PETITION FOR APPROVAL OF TRANSFER OF STRUCTURED SETTLEMENT PAYMENT RIGHTS

On September 25, 2020, Petitioner Camaby Carljule, LLC (“Petitioner”) filed this petition for approval of transfer of structured settlement payment rights. The petition seeks transfer of certain structured settlement payment rights held by A.B. (“Payee”) under a medical malpractice injury claim from 2005. (Petition ¶ 2; A.B. Decl. ¶ 4.) If approved, Payee will transfer to Petitioner 60 monthly payments of $1,000.00 commencing September 1, 2022 through and including August 1, 2027. (Petition ¶ 3.) In exchange, Petitioner will pay Payee $15,535.45.

A direct or indirect transfer of structured settlement payment rights is not effective unless the transfer has been approved in a final court order based on certain express written findings by the Court. (Ins. Code, § 10139.5, subd. (a).)
