Nature of Proceedings: Petition for Letters of Administration and Petition to Determine Ownership of Estate Property

Appearances required. Parties must come prepared to narrow issues for trial.

The following must be submitted before the Petition may be granted:

1) Waivers of Bond – This matter is contested, and even if it were not, bond should not be waived unless waived by all adult heirs at law. Petitioner must file bond waivers (Form DE-142) for all heirs. If waivers cannot be obtained, the Court should not waive bond.

2) Supplement to the Petition – The following allegations must be made without creating ambiguity, but were left blank or improperly alleged and must be corrected by supplement:

- Paragraph 5a(7) or (8)

- Paragraph 7 – A supplement to the petition explaining how the 7b(1) and 7b(2) do not apply.
