TENTATIVE RULING
Sandra Boneso, dba Camino Del Roble Senior Living (“Petitioner”), filed this verified Petition for Judgment of Abandonment, for Past Due Rent, Related Charges, and for Attorney’s Fees and Costs pursuant to Civil Code section 798.61 on February 7, 2020. Petitioner owns and operates the Camino Del Roble Senior Living mobilehome park, located at 2115 El Camino Real in Atascadero, California.
Petitioner has now submitted the verified Petition, proofs of service, a request for default and proposed default judgment, and, at the request of the Court, a supplemental memorandum and a supplement regarding due diligence.
An abandoned mobilehome is one that is a) located in a mobilehome park on a site for which no rent has been paid to the management for the preceding 60 days; b) unoccupied; c) a reasonable person would believe it to be abandoned; and d) is not permanently affixed to the land. (Civ. Code, § 798.61(a)(1).)
