TENTATIVE RULING
Adriane Even Walker-Bailey (“Petitioner”) filed this Request for Civil Harassment Restraining Orders pursuant to Code of Civil Procedure section 527.6 on May 15, 2020 against Casey Nugent. (20CVP-0154) On that same date, Petitioner filed a related Request for Civil Harassment Restraining Order pursuant to Code of Civil Procedure section 527.6 against Paul Nugent. (20CVP-0155).
Both actions arise out of a neighbor dispute. Casey Nugent and Paul Nugent (collectively “Respondents”) both filed oppositions to the petitions.
Petitioner thereafter filed Requests for Dismissal as to the entire action of all parties and all causes of action, and on July 7, 2020, dismissals without prejudice were entered in both actions.
Respondents, who were both represented by the same counsel, now bring a motion for their attorney fees and costs pursuant to Code of Civil Procedure section 527.6(s) and section 1032(b) as the prevailing parties. (Code Civ. Proc., § 527.6(s) [“The prevailing par
