According to the allegations of the complaint, Maria Vicencio (“Plaintiff”) had a business partnership and a romantic partnership with Abelardo Shiraki (“Defendant”); Plaintiff and Defendant also had a child together but never married. (See complaint, ¶¶ 7-8.) In February 2017, Plaintiff purchased real property at 19 Harriet Avenue in San Jose, California (“Property”). (See complaint, ¶ 9.) Plaintiff used her own funds to purchase the Property and to renovate it in the months that followed. (See complaint, ¶¶ 9-11.) In October 2017, Plaintiff executed a deed grant deed to convey title to the Property to herself and Defendant as tenants in common with each holding an undivided 50-percent interest in the Property as an unmarried individual. (See complaint, ¶ 13.) Plaintiff alleges she felt pressured by Defendant to sign the deed even though he did not contribute funds for the purchase of the Property. (See complaint, ¶¶ 14-15.)
