In this wrongful foreclosure action, plaintiff Thressa Young (“Young”) alleges defendants Blue Sky Capital Realty, Inc., dba Elite Loan Servicing, Metro Capital Fund, LLC (“MCF”), and S.B.S. Trust Deed Network (“S.B.S”) violated multiple provisions of the Homeowners Bill of Rights (“HBOR”). Young acquired a $29,586.97 Home Equity Credit Line Revolving Loan Agreement in 2007 from Residential Capital Mortgage Income Fund, LLC, secured by a deed of trust on 929 W. Myrrh Street, Compton, California 90220. On February 22, 2013, the deed of trust was assigned to MCF. On March 31, 2020, S.B.S. was substituted in as trustee. A notice of default and election to sell were recorded the same day. The Complaint was filed on June 23, 2020. A notice of trustee’s sale was recorded on July 16, 2020.
