This is primarily an action for wrongful death brought by Plaintiffs Rekha Bodalia, Krunal Bodalia and Dhruti Bodalia (“Plaintiffs”) the wife and adult children of Decedent Natvarlal Bodalia (“Decedent”). On Dec. 9, 2014 Decedent was stuck by a car driven by Defendant Arun Ravidran (“Defendant”) while Decedent was walking in a crosswalk in Sunnyvale (Defendant argues this was a suicide, as there was a handwritten note in Decedent’s wallet to that effect and Plaintiffs do not dispute that the note was in Decedent’s handwriting). Decedent survived the initial impact but died of his injuries at the hospital a few hours later. Plaintiffs’ original and still operative Complaint filed November 10, 2015 states five causes of action: 1) Wrongful Death; 2) Negligence /Motor Vehicle (alleging Defendant violated Vehicle Code §21950); 3) Negligence Per Se; 4) Loss of Consortium (by Decedent’s wife and Successor in Interest Rekha Bodalia only), and; 5) Wrongful Death Survival Action (also by ........
