Plaintiffs have sufficiently demonstrated that an issue of fact exists as to whether Defendant Patricia Lopez is individually responsible for violations of Labor Code sections 558 or 1197.1. There is testimony that would support the conclusion that Defendant Lopez personally cut short employees’ rest breaks and lunch breaks, and required employees to wait in line to clock in and to doff protective equipment prior to clocking in, so that they would be at their stations and ready to work the moment their shifts began, thus causing damage to employees due to the loss of paid time. Summary judgment is therefore denied.
