[TENTATIVE] ORDER RE: PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT OR SUMMARY ADJUDICATION; MOTION TO STAY

On August 20, 2019, plaintiff Catamount Properties 2018, LLC (“Plaintiff”) filed a complaint for unlawful detainer against defendant Winonia Strickland Myles (“Defendant”) concerning Defendant’s property, which Plaintiff purchased in a foreclosure sale. On September 5, 2019, Defendant filed a complaint for wrongful foreclosure, fraud and other causes of action against Plaintiff and other defendants. Defendant alleged that she had fully paid off her mortgage pursuant to a forbearance agreement before the foreclosure sale and therefore the foreclosure sale was unlawful.

On November 5, 2019, the Court related the two cases. In this case, Plaintiff filed a motion for summary judgment or summary adjudication of all affirmative defenses in Defendant’s answer.
