Plaintiff, Giselle Maya, a minor by and through her GAL, Jose Maya, filed this action against Defendants, St. Mary’s Hospital of Long Beach, Clinica Sierra Vista, College Medical Center, Fred Adams, M.D., and Bryuce B. Taylor, D.O. for:
Professional Negligence (Negligence Per Se);
Willful Misconduct;
Wrongful Life (Negligence Per Se);
Violation of Statutes and Regulations.
Plaintiff alleges Defendants failed to administer necessary pre-natal tests that would have revealed, in utero, that she has spina bifida. Plaintiff alleges that, had Defendants administered such tests, her parents would have aborted the pregnancy. The case was originally assigned to the personal injury hub courts in the Spring Street Courthouse, but was transferred to the Long Beach Courthouse due to its complex nature. The transfer of the case and the ensuing pandemic led to lengthy delays in the hearing of the matters on calendar today.
