Mercury Insurance Company v. Hilliard

Petitioner’s Motion for a Protective Order is DENIED in part and GRANTED in part. The Court grants the motion to the extent the subpoena requires Mercury to produce a witness to testify as to “Allstate Insurance Company’s” investigation. The motion is otherwise denied.

This action arises out of a car collision that occurred on April 20, 2015. Respondent claims that she was injured in the collision as a result of the negligence of an underinsured driver. Respondent made a demand for underinsured motorist coverage benefits from her insurer, Mercury Insurance Company, and an underinsured arbitration was commenced. During the course of discovery, Respondent served a deposition subpoena on Mercury seeking the deposition of Mercury’s person most qualified and the production of certain documents. Mercury seeks a protective order.
