FACTUAL BACKGROUND: Plaintiff Mary Swanston alleges that she is an elder as defined in the Welfare and Institutions Code, as her birthday is October 15, 1919, and that on January 21, 2019, she was admitted to defendant Arcadia Gardens Retirement Hotel (“Arcadia Gardens”) following a hospital stay because she had fallen at home, and so needed assistance with activities of daily living.
The complaint alleges that at the time of admission, plaintiff’s skin was free of any wounds or pressure sores. On May 2, 2019, an Arcadia Gardens caregiver came to check on
