Motion to Quash Subpoena; Motion to Compel Deposition

The Court considered the moving, opposing, and reply papers in relation to the motion to quash a subpoena. The Court also considered the moving and opposing papers in relation to the motion to compel a deposition. No reply papers were filed in response to the motion to compel a deposition. The Court rules as follows.

BACKGROUND

On July 22, 2019, Plaintiff Ame Lopez (“Plaintiff”) filed a complaint against Defendants Guillermo Hernandez and Elias Chavez (“Defendants”). The complaint alleges motor vehicle and general negligence for an automobile collision that occurred on February 1, 2018.

On November 8, 2019, the Court entered default against Defendant Guillermo Hernandez.

On January 10, 2020, Plaintiff filed a motion to quash a deposition subpoenas pursuant to California Code of Civil Procedure section 1987.1.
