Background
On July 17, 2019, plaintiffs Kareen Lopez, Jimmy Calderon, Kareen Lopez as guardian ad litem for minor K. Alvarado, and Kareen Lopez as guardian ad litem for minor J. Calderon (collectively “Plaintiffs”) commenced this action arising out of a landlord-tenant relationship between defendants Shahnaz Gabayan, Peter Gabayan, (collectively “Defendants”) on the one hand and Plaintiffs on the other. On November 6, 2019, Plaintiffs filed a First Amended Complaint (“FAC”) for (1) breach of contract, (2) breach of implied warranty of Habitability/Tenantability, (3) Breach of Implied Warranty of Quiet Enjoyment, (4) Negligence, and (5) Nuisance.
