INTRODUCTION
Defendant Larry Allen moves to Quash Subpoenas Duces Tecum served upon:
1. John Toro D.C.
2. Gennesse Medical Group
3. Kaiser Foundation Hospital
4. Sharp Rees Medical Group
Each of the subpoenas are addressed by separate motions which the court has consolidated for hearing today.
NATURE OF CASE
Plaintiff Adan Flores claims damages for personal injuries suffered in a collision with a truck driven by Larry Allen in the course of his employment with a Co-Defendant.
THE SUBPOENAS
Each subpoena is similar in scope. All demand records from December 2, 2009 to the present. Three have the scope of records limited to “Head/brain/ eyes” which, in the court’s opinion isn’t much of a limitation.
The subpoena to Jon Toro D.C. seeks:
“all documents and records in any format . . . from 12/2/09 – present, including but not limited to all office and outpatient charts and records . . . chiropractic records, radiology reports, DMV medical examination reports for patient: Larry A
