Defendant Specialized Loan Servicing, LLC’s Special Motion to Strike is DENIED.
Background
This is the third in a series of lawsuits initiated by Plaintiff Robert Daniels against Defendant Specialized Loan Servicing regarding the servicing of Plaintiff’s mortgage and home loan and Defendant’s efforts to foreclose. On August 22, 2014, Plaintiff initiated Lawsuit #1 against Defendant (L.A. Superior Court Case No. BC55547). That case, a relatively straightforward wrongful foreclosure action, settled quickly; the parties entered a Settlement Agreement pursuant to which Plaintiff could reinstate the loan by remitting a specified payment to SLS.
